On Tuesday, a Houston judge decided in favor of Texans owner Janice McNair, refusing her oldest son’s plea for an independent medical assessment to assess her mental ability, according to the Houston Chronicle.
Robert Cary McNair Jr. is seeking guardianship, saying that Janice McNair’s stroke in January 2022 rendered her intellectually incapable and limited in her ability to conduct business.
Cal McNair, her other son and CEO and chair of the Texans, and Janice McNair’s counsel contended that the 87-year-old widow of Bob McNair had already been examined by two doctors.
“On behalf of Mrs. McNair and everyone who opposed the motion, we are pleased with Judge [Jerry] Simoneaux’s order denying Cary McNair’s motion for an independent medical examination of Mrs. McNair,” Janice McNair’s attorney Don Jackson told the newspaper. “We want to thank Judge Simoneaux and his staff for their diligent efforts.”
Attorneys for Janice McNair are anticipated to request that Simoneaux dismiss the probate lawsuit.
On November 27, Cary McNair’s solicitors filed an application for guardianship.
